swinph Terms & Conditions — Rules Governing Use of the swinph Platform

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the swinph online gaming platform, operated at swinph.cam ("Platform", "swinph", "we", "us", or "our"). By accessing the Platform, registering an account, making a deposit, or placing any wager, you ("Player", "User", "you") agree to be legally bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must immediately cease using the swinph Platform and refrain from creating or accessing any account. Continued use of the Platform following the publication of any amended Terms constitutes acceptance of those amendments.

These Terms are written in English. In the event of any translation or localized version, the English text shall prevail in all cases of inconsistency or ambiguity.

2. Eligibility

In addition to the age requirement, the following eligibility conditions apply to all Players:

• You must be a natural person (not a corporate entity or artificial legal person) creating an account for personal, non-commercial use.
• You must be legally permitted to access online gaming services under the laws applicable to your country or jurisdiction of residence. It is your sole responsibility to determine whether using swinph is lawful in your jurisdiction.
• You must not be a current employee, director, officer, or agent of swinph, or an immediate family member of such a person, where such relationship would create a conflict of interest.
• You must not have been previously excluded from the swinph Platform or any other gaming platform operated within the PAGCOR regulatory framework.
• You must not be registered on any self-exclusion program that prohibits participation in online gambling activities.

swinph reserves the right to request proof of age, identity, or residency at any time. Accounts where eligibility cannot be verified may be suspended pending investigation, with affected funds held in escrow.

3. Account Registration

To access real-money gaming features on swinph, you must register a player account. The following rules apply to all swinph accounts:

• One Account Per Person: Each individual may hold only one active swinph account at any time. Creating multiple accounts — whether under the same identity or under different names or contact details — is strictly prohibited and constitutes a breach of these Terms.
• Accurate Information: You must provide truthful, accurate, and complete information during registration, including your legal full name, Philippine mobile number, and date of birth. Providing false, misleading, or fraudulent information is grounds for immediate account suspension and forfeiture of any balance.
• Account Security: You are solely responsible for maintaining the confidentiality of your swinph login credentials. You must not share your username, password, or one-time PIN with any other person. swinph will not be liable for any loss or damage arising from unauthorized access to your account due to your failure to maintain credential security.
• Verification (KYC): swinph may require you to complete identity verification (Know Your Customer) procedures at any stage. This may include submission of government-issued identification, proof of address, and proof of payment method ownership. Verification must be completed before withdrawals are processed and may be required before account activation.
• Contact Information: You must keep your registered contact details, including your mobile number, up to date. swinph uses your registered mobile number for account security, OTP delivery, and important account notifications. Failure to maintain accurate contact details may affect your ability to access your account.

swinph reserves the right to refuse any registration application at its sole discretion and without obligation to provide reasons for that refusal.

4. Deposits & Payments

swinph accepts deposits denominated in Philippine Pesos (PHP) via the following payment methods: GCash, Maya, BPI, BDO, Metrobank, and GrabPay, subject to availability at the time of transaction.

• Minimum Deposit: The minimum deposit amount is ₱100, unless otherwise specified for a particular promotion or payment method.
• Deposit Credits: Deposits are credited to your swinph account in real time upon successful payment confirmation. swinph is not responsible for delays caused by the payment provider or the player's financial institution.
• Funding Source: You warrant that all funds deposited into your swinph account are from a legitimate source and that you are the authorized account holder of the payment method used. Deposits from third-party payment accounts are not permitted.
• Currency: All transactions are processed in Philippine Pesos. swinph does not currently accept foreign currency deposits. Any currency conversion costs are the sole responsibility of the player.
• Transaction Fees: swinph does not charge transaction fees on standard deposits, though individual payment providers may impose their own fees. Players should check with their payment provider for applicable charges.

5. Withdrawals

swinph processes withdrawal requests to GCash and Maya within 1–2 hours of approval. Bank transfers via BPI, BDO, and Metrobank are subject to the receiving institution's standard processing timelines, which may vary.

• Minimum Withdrawal: The minimum withdrawal amount is ₱200, unless otherwise specified.
• Identity Verification: All withdrawals are subject to identity verification. First-time withdrawal requests will require KYC document submission. Withdrawals will not be processed until verification is complete.
• Withdrawal Method: Withdrawals must be made to the same payment method used for deposits where technically feasible. swinph reserves the right to determine the withdrawal method at its discretion in cases of payment method unavailability.
• Pending Wagering Requirements: Withdrawal requests will not be approved while bonus wagering requirements remain outstanding. Real-money funds deposited independently of any bonus are generally withdrawable after standard identity checks.
• Processing Time: While swinph targets 1–2 hour GCash and Maya processing, swinph reserves the right to extend processing timelines for withdrawals requiring additional security review, regulatory compliance checks, or during periods of high withdrawal volume.
• Unclaimed Funds: swinph reserves the right to close dormant accounts and handle unclaimed balances in accordance with applicable Philippine law and regulatory requirements.

6. Bonuses & Promotions

swinph offers various promotional incentives to eligible players, including welcome bonuses, reload bonuses, free spins, cashback offers, and referral rewards. The following general terms apply to all swinph promotions unless otherwise stated in the specific promotion's terms:

• Wagering Requirements: Bonus funds and any winnings generated from bonus funds are subject to wagering requirements as specified in each promotion. Players must complete the stated wagering requirement before bonus-related winnings become withdrawable.
• Validity Period: All bonuses have an expiry period from the date of issue or the date of first deposit activation, as specified. Bonus funds that are not used or wagered within the validity period will be forfeited automatically.
• Eligible Games: Not all games contribute equally toward wagering requirements. Live casino games, slots, and other game categories may carry different wagering contribution percentages. Full contribution details are listed in each promotion's specific terms.
• One Bonus at a Time: Players may not hold more than one active bonus simultaneously unless explicitly permitted by a specific promotion.

• Changes and Withdrawal: swinph reserves the right to modify, suspend, or cancel any promotion at any time. Promotions are offered at swinph's sole discretion and may be restricted to specific player segments.

7. Game Rules & Fairness

All games available on the swinph Platform — including live casino tables, slot machines, bingo rooms, fish shooting games, and other titles — are governed by individual game rules published within each game's interface or help section.

• Random Number Generation: All non-live-dealer games on swinph use independently certified Random Number Generators (RNG) to determine game outcomes. RNG certification is maintained and subject to periodic audit by third-party testing laboratories.
• Live Dealer Games: Live dealer game outcomes are determined by physical actions (card dealing, roulette wheel spin, etc.) performed by real dealers in professionally managed studios. These games are subject to the operational rules of the respective game provider.
• Return to Player (RTP): Published RTP percentages for slot games represent theoretical long-term averages based on certified test results. Individual session outcomes will vary and may differ significantly from published RTP figures over short periods.
• Malfunctions: In the event of a technical malfunction or game error that causes an incorrect outcome or disruption to gameplay, swinph reserves the right to void the affected round and refund the relevant stake. swinph does not guarantee uninterrupted or error-free game availability.
• Bet Limits: Minimum and maximum bet limits apply to all games and are displayed within the game interface. swinph reserves the right to adjust bet limits at any time.

8. Prohibited Conduct

The following activities are strictly prohibited on the swinph Platform and constitute grounds for immediate account suspension, forfeiture of funds, and potential legal action:

• Creating or operating multiple swinph accounts under any identity.
• Using automated software, bots, artificial intelligence tools, or scripts to interact with the Platform or manipulate game outcomes.
• Engaging in any form of fraud, including payment fraud, chargeback fraud, identity fraud, or the use of stolen financial instruments.
• Collusion with other players to gain an unfair advantage in any game.
• Exploiting software vulnerabilities, bugs, or technical errors — whether discovered intentionally or accidentally — to obtain funds or other advantages not intended by swinph. Players who discover such vulnerabilities are obligated to report them to swinph support immediately.
• Attempting to launder money or use the swinph Platform for any purpose connected to illegal financial activity.
• Providing false information during registration, verification, or any communication with swinph.
• Accessing the Platform from a jurisdiction where online gambling is prohibited, where swinph does not hold the necessary authorizations to operate.
• Engaging in abusive, threatening, or harassing behavior toward swinph staff, other players, or live dealers.

9. Responsible Gaming

swinph is committed to promoting responsible gaming and providing a safe gaming environment for all Filipino players. By using the swinph Platform, you acknowledge that gaming involves financial risk and that outcomes are determined by chance.

• Responsible Gaming Tools: swinph provides the following responsible gaming tools, accessible directly within your account settings: deposit limits (daily, weekly, monthly), session time reminders, cooling-off periods, and voluntary self-exclusion.
• Self-Exclusion: Players who wish to exclude themselves from the swinph Platform temporarily or permanently may activate self-exclusion through their account settings or by contacting swinph support. Self-exclusion is effective immediately upon activation. Requests to reverse a self-exclusion are subject to a mandatory cooling-off period.
• Age Verification: swinph strictly enforces the 21+ age requirement through registration checks and document verification. Players who become aware that an underage individual is accessing their account must report this to swinph immediately and take steps to prevent further access.

10. Intellectual Property

All content on the swinph Platform — including but not limited to the swinph brand name, logo, website design, game graphics, software, text, images, and audio — is the proprietary property of swinph or its licensed third-party content providers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the swinph Platform for personal, non-commercial gaming purposes only. This license does not permit you to:

• Copy, reproduce, distribute, or publicly display any swinph content without prior written authorization.
• Reverse engineer, decompile, or extract source code from any swinph software or game.
• Use swinph branding or trademarks in any manner that could cause confusion or suggest affiliation without authorization.

Any unauthorized use of swinph intellectual property may result in account suspension and may expose the infringing party to civil and criminal liability under Philippine intellectual property law.

11. Limitation of Liability

To the fullest extent permitted by applicable Philippine law, swinph's total liability to any player arising from or in connection with their use of the Platform shall not exceed the net deposits made by that player in the 12 months preceding the claim.

swinph shall not be liable for any of the following, whether arising in contract, tort, or otherwise:

• Loss of winnings due to technical malfunction, connectivity failure, or circumstances beyond swinph's reasonable control.
• Loss or damage arising from a player's failure to maintain account security, including unauthorized access resulting from password disclosure.
• Indirect, consequential, special, or punitive damages of any nature.
• Any loss arising from a player's reliance on information published on the Platform that is subject to change without notice.
• Interruptions to the Platform caused by maintenance, infrastructure upgrades, or third-party service provider failures.

Nothing in these Terms limits swinph's liability for fraud, willful misconduct, or any other liability that cannot be excluded under applicable law.

12. Account Suspension & Termination

swinph reserves the right to suspend, restrict, or permanently close any player account, with or without prior notice, in the following circumstances:

• Breach of any provision of these Terms.
• Receipt of a regulatory directive or court order requiring account suspension.
• Reasonable suspicion of fraud, money laundering, or other illegal activity.
• Discovery that a player does not meet the eligibility requirements outlined in Section 2.
• Failure to complete required KYC verification within a reasonable time frame.
• Account inactivity for a period exceeding 12 consecutive months.

Upon account closure, swinph will conduct a final review of the account balance and any pending transactions. Verified funds not subject to forfeiture will be returned to the player via their registered payment method within a reasonable time, subject to legal and regulatory requirements.

Players may also voluntarily close their swinph account at any time by contacting swinph support. Voluntary account closure does not prejudice any outstanding wagering requirement obligations or pending verification procedures.

13. Privacy & Data Protection

swinph collects, processes, and stores personal information in accordance with its Privacy Policy and applicable Philippine data protection legislation, including the Data Privacy Act of 2012 (Republic Act No. 10173).

By registering an account, you consent to swinph collecting and processing your personal data for the purposes of account management, identity verification, transaction processing, regulatory compliance, and — where you have provided consent — marketing communications.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the Philippines. Players agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims.

For disputes that do not require court intervention, swinph encourages players to contact the swinph support team in the first instance. swinph is committed to resolving player disputes promptly and fairly, in accordance with its complaint handling procedures and applicable regulatory requirements.

15. Amendments to These Terms

swinph reserves the right to amend, update, or replace these Terms at any time. When material changes are made, swinph will notify registered players via their registered mobile number or by displaying a notice on the swinph Platform prior to the changes taking effect.

The date of the most recent revision is displayed at the top of this document. It is your responsibility to review these Terms periodically. Your continued use of the swinph Platform following publication of amended Terms constitutes your acceptance of those changes.

If you disagree with any amendment, you must stop using the Platform and may request account closure by contacting swinph support before the effective date of the changes.
